The YMCA of Greater Dayton (OH), along with the Huber Heights (OH) YMCA and three other defendants, are being sued by the family of a toddler who drowned at the Y's aquatic center in 2012.
Three-year-old Tyree Dukes was found floating in the pool of the Kroger Aquatic Center at the Huber Heights YMCA on July 4, 2012, the Dayton Daily News reported. CPR was administered, and the boy was rushed to a nearby hospital where he was pronounced dead. The death was ruled an accidental drowning by the coroner's office.
The Kroger Aquatic Center, The Kroger Co. and the city of Huber Heights also are named in the lawsuit, according to the newspaper.
Tim Helm, president and CEO of the YMCA of Greater Dayton, told the newspaper the drowning was believed to be the first at the Y in at least 50 years.
After an investigation, the Kroger Aquatic Center adopted new rules. From the Dayton Daily News:
Among the new procedures, the center began requiring visitors to wear colored wristbands so lifeguards could identify those with fatigue and inattention; lifeguard chairs were to be moved closer to the pool to provide better line of sight for better scanning and recognition of swimmers; and a crackdown on enforcement of its missing child policy to reunite the child with their parent.
