Ephedra Ban Upheld

DENVER, CO—On Aug. 17, the U.S. Court of Appeals for the Tenth Circuit in Denver upheld the Food and Drug Administration’s final rule declaring all dietary supplements containing ephedrine alkaloids adulterated, and therefore illegal for marketing in the United States. This ruling reverses an April 2005 decision by the District Court of Utah that threw out the part of the ban that prohibited the sale of products with less than 10 mg of ephedra per day.
